A jury decided Tuesday that the Oregon Department of Human Services was not financially liable when the mother’s boyfriend, Samuel Rich, beat the 2-year-old, leaving him quadriplegic, despite failing to take action when informed that the child had been treated for opiates poisoning.
However, lawyer Scott Kocher, who is advocating for the child, claims that the verdict was in violation of Oregon law, which stipulates that three-fourths of jurors must concur in a civil case. He wants a new trial set and the verdict overturned.
