New York State Issues First Cannabis Product Recall Over Safety Concerns

In a notable move for New York’s expanding cannabis industry, state regulators have announced their first product recall, affecting consumers from Harlem to Hollis. This recall underscores the critical importance of consumer safety in the swiftly developing legal cannabis market.

The New York State Office of Cannabis Management (OCM) has issued a recall for all cannabinoid hemp products, including the “Sky High” brand, produced by Eat Sky High LLC. These products were distributed through licensed cannabis and cannabinoid hemp dispensaries throughout the state.

The recall targets products from an unlicensed cannabinoid hemp processor that have multiple safety violations, posing risks to public health. The OCM initiated this recall as a precautionary measure since the necessary testing for consumer safety and product quality could not be verified.

While there have been no reported adverse effects from consuming these products, the OCM’s investigation continues. Violations associated with these products include processing at an unlicensed facility, unverified THC-A levels, and failure to meet OCM testing standards. Additionally, there are labeling violations, such as missing warnings, processor information, and lot numbers. Some products were produced with hazardous food items, and there were instances of misleading labeling that made the products appear as authorized adult-use items with NYS Universal Symbol imagery.

The affected products span various categories, including dessert toppings, dipping sauces, condiments, and ice cream/gelato/sorbet. Specific products include:

Dispensaries and distributors must halt the distribution and sale of these products immediately. Consumers who purchased any products from Eat Sky High LLC and wish to return them should contact the retail dispensary where the products were purchased. Recalled products can be returned even if they have been opened.
