Mario Kelly, a 38-year-old resident of Buffalo, New York, has been sentenced to 130 months in prison by U.S. District Judge Richard J. Arcara. This follows Kelly’s conviction for possession with intent to distribute over 40 grams of fentanyl and for being a felon in possession of firearms and ammunition, as announced by U.S. Attorney Trini E. Ross.
Assistant U.S. Attorney Meghan E. Leydecker, who prosecuted the case, detailed that in April 2022, law enforcement officers executed a search warrant at Kelly’s residence in Kenmore. During the search, they discovered approximately 374 grams of fentanyl, along with about seven grams of crack cocaine, drug paraphernalia, and three firearms. Kelly’s previous felony convictions in both Erie County Court and the Western District of New York had legally barred him from possessing firearms.
The sentencing outcome was the culmination of an investigation conducted by the Buffalo Police Department, under the leadership of Commissioner Joseph Gramaglia, and the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF), led by Special Agent-in-Charge Bryan Miller of the New York Field Division.
Kelly’s case underscores ongoing efforts by law enforcement agencies to combat drug trafficking and illegal firearm possession in Buffalo and the surrounding areas. The collaborative efforts between local and federal authorities highlight their commitment to ensuring public safety and upholding the law in the community.
